Welcome to Arisevo (“Company,” “we,” “us,” or “our”).

Arisevo operates this website and online store, including all related content, information, tools, products, and services (collectively, the “Services”). The Services are hosted and powered by Shopify Inc.

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Arisevo and govern your access to and use of the Services, as well as the purchase and use of any products offered through the Services.

BY ACCESSING, USING, OR PURCHASING FROM THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER SET FORTH BELOW.

If you do not agree to these Terms, do not use the Services.

3. ELIGIBILITY

By using the Services, you represent and warrant that:

  • You are at least 18 years old

  • You have the legal capacity to enter into a binding agreement

  • All information you provide is accurate and current

  • Purchases are for personal, non-commercial use only, unless expressly authorized in writing by Arisevo

We reserve the right to refuse service, cancel orders, or terminate access for violations of these Terms.

You are responsible for all activity conducted under your account.

4. PRODUCT CATEGORY & INTENDED USE

Arisevo products are non-medical consumer wellness and posture-awareness devices intended solely for general comfort, posture feedback, and personal well-being.

Products provide vibration-based posture reminders only and do not actively correct posture or modify skeletal alignment.

Products are designed for personal, at-home use only and are not intended for professional, clinical, therapeutic, or rehabilitative use.

They do not alter the structure or function of the body.

5. GENERAL WELLNESS & NON-MEDICAL DISCLAIMER

Arisevo products are general wellness devices only.

They are:

  • NOT medical devices

  • NOT FDA-cleared or FDA-approved medical equipment

  • NOT intended to diagnose, treat, cure, or prevent any disease or medical condition

  • NOT a substitute for professional medical care

The product has not been evaluated by the U.S. Food and Drug Administration (FDA).

No medical, therapeutic, or health claims are made.
Individual experiences vary and results are not guaranteed.

6. NO MEDICAL ADVICE

Information provided through the Services is for general informational purposes only and does not constitute medical advice.

You should consult a licensed healthcare professional before using the product if you:

7. MATERIALS, SKIN CONTACT & SENSITIVITY

The product housing is manufactured using ABS (Acrylonitrile Butadiene Styrene) and PC (Polycarbonate) materials commonly used in consumer electronics.

While these materials are widely utilized for external consumer products, individual sensitivities may vary.

By using the product, you acknowledge and agree that:

  • Skin irritation, sensitivity, or discomfort may occur

  • A skin contact test is recommended prior to extended use

  • The product should not be used on broken, inflamed, or irritated skin

  • Use must be discontinued immediately if irritation, pain, or discomfort occurs

You assume full responsibility for any skin reactions or sensitivities.

8. CHEMICALS & MATERIAL COMPLIANCE DISCLAIMER

Arisevo products are designed for consumer use and sourced from third-party manufacturers.

We do not intentionally add BPA or other restricted substances to our products. However, we rely on supplier-provided material information and manufacturing processes.

No representation or warranty is made that the product is free from all trace chemicals, including BPA or similar substances, under all possible conditions of use.

If required by applicable law, appropriate warnings will be provided on the product packaging or product page.

9. VIBRATION & ELECTRICAL SAFETY

Products utilize low-intensity vibration components powered by rechargeable electronics.

By purchasing or using the product, you acknowledge and agree that:

  • Improper or excessive use may cause discomfort

  • The product must not be used while charging

  • The product must be kept away from water or moisture

  • Only approved charging equipment may be used

  • The product must be kept out of reach of children

  • The product must be worn over clothing and not directly on bare skin for extended periods

You agree to follow all instructions and safety guidelines provided with the product.

10. ASSUMPTION OF RISK

You voluntarily assume all risks associated with the use or misuse of the product, including but not limited to:

  • Skin irritation or sensitivity

  • Discomfort from vibration feedback

  • Improper fit or positioning

  • Failure to follow provided instructions

11. PRODUCT PRESENTATION DISCLAIMER

Product images, videos, descriptions, testimonials, and marketing materials are for illustrative purposes only.

Actual product appearance, materials, packaging, or performance may vary.

Testimonials reflect individual experiences and do not guarantee results.

We reserve the right to modify or discontinue products at any time without notice.

12. ORDERS & BILLING

All orders constitute an offer to purchase and may be accepted or rejected at our discretion.

Orders generally cannot be modified or canceled once placed.

You authorize us to charge your selected payment method for all amounts due.

We reserve the right to cancel orders suspected of fraud, abuse, or unauthorized resale.

13. SHIPPING & INTERNATIONAL FULFILLMENT

Orders may ship from international fulfillment centers.

You acknowledge that:

  • Delivery times are estimates, not guarantees

  • Delays due to customs or carriers may occur

  • Accurate shipping information is your responsibility

  • Orders marked as delivered by the carrier are considered fulfilled

14. RETURNS & PAYMENT DISPUTES

Returns are governed by our Refund Policy.

We reserve the right to contest improper chargebacks or abusive dispute behavior.

Customers engaging in excessive or fraudulent disputes may be refused future service.

15. USER CONTENT LICENSE

By submitting reviews, images, videos, or other content, you grant Arisevo a perpetual, worldwide, royalty-free, irrevocable license to use such content for marketing, promotional, and business purposes.

16. INTELLECTUAL PROPERTY

All content on the Services is owned by Arisevo or its licensors and protected by intellectual property laws.

Unauthorized use is prohibited.

17. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

18. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT PAID FOR THE PRODUCT, OR

  • USD $100

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM USE OR MISUSE OF THE PRODUCT.

19. INDEMNIFICATION

You agree to indemnify and hold Arisevo harmless from any claims, damages, or expenses arising from misuse of the product or violation of these Terms.

20. INFORMAL DISPUTE RESOLUTION

Before initiating arbitration, you agree to contact support@arisevo.com and allow 30 days for informal resolution.

21. ARBITRATION & CLASS ACTION WAIVER

Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration shall be conducted on an individual basis

  • No class actions or representative claims

  • Arbitration may take place remotely or in New York, New York

  • Small claims court remains permitted

Opt-Out: You may opt out within 30 days of purchase by emailing support@arisevo.com with your full name and order number.

22. GOVERNING LAW

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, and without depriving consumers of mandatory rights under applicable consumer protection laws, including those of their state of residence.

23. ELECTRONIC COMMUNICATIONS

You consent to receive communications electronically.

24. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our reasonable control.

25. SEVERABILITY & ENTIRE AGREEMENT

If any provision is deemed invalid, the remaining provisions remain enforceable.

These Terms constitute the entire agreement between you and Arisevo.
